Who this is

gerald.digital is the public name for this service. We build a new website for a shop, trade, cafe, or local service that is already open. Then we host it on a monthly plan. We do not take over a site someone else built. We do not send invoices.

Work is taken anywhere. Visits are for current clients within about two hours’ drive, when a visit helps.

Charges and receipts use the legal name on the Stripe account for gerald.digital. Service is based in Augusta, Maine, United States.

Questions and cancel notices: use the form on https://gerald.digital/ or the mail button on any page.

What you are buying

Prices are in US dollars. Card processing is already inside the number. There is no surcharge line. The price does not fall because you stayed a year. Year two costs the same as year one unless we both agree to a different plan in writing.

You start by card. Bank debit can be set up after you start if you ask. Charges appear as gerald.digital or g.d web.

Start, cancel, refund

You send the form. The next page is payment. Work starts when the first payment lands. That first charge is the start fee and the first month. We keep it unless we decline the job.

A typical finish is about two weeks after we have your brief and photos, then we host it month to month. Queue can change that.

There is no three-month minimum. To stop, send written notice at least 30 days before the date you want service to end. Service ends at the close of the paid period after that notice. No mid-cycle refund. No proration. The month already paid stays paid.

If we cannot take the job after the first charge, we refund that first charge in full and close the form. That is the only start-fee refund.

A form with no Stripe payment is closed after seven days. Nothing to refund.

Thirty days past due: the live site becomes a construction page that still shows the business contact info. Fifteen days after that still unpaid: the site comes down.

If we end the service

We can end a plan with 30 days’ written notice. Your site stays up through the end of the period you already paid for, so there is nothing to refund. We can end it right away, with no refund, for illegal content, abuse, or a disputed charge.

What we deliver

No physical goods and no shipping. Delivery is a hosted website. The domain stays in your name. Google listing access stays in your name. While a plan is active, we host the live files.

After 12 paid months, if you cancel, you may ask for a folder of the site files (HTML and CSS). We send it within 30 days of the last payment. Those files may not work the same on another host. Pictures and forms tied to our setup may be missing or inert. Leave before 12 paid months: no file folder. Hosting ends on the past-due schedule if payment stops.

We make the design decisions. Send your logo, colors, photos, and anything you want considered before the build starts. One round of revisions on the first design is included before launch. After launch, small changes go through the monthly updates. Bigger design changes are Custom.

Unlimited updates are not a new sitemap, a rebrand, a full redesign, or a cart. A large rebrand is Custom: we phase it or we price a flat overhaul.

Most updates go live within two business days. Send what you have in one email when you can, and changes go live in the order they arrive. Closing for weather? Tell us and we’ll post it as fast as we can. If requests start taking more time than your plan covers, we’ll talk with you about Custom before anything changes.

Who owns what

Your business name, logo, photos, words, domain, and Google listing are yours. You confirm you own them or have permission to use them. If something you send us breaks someone else’s rights, you are responsible for any claim that comes from it.

We own the design and code we make. While your plan is active, you use it on your site. After 12 paid months, the folder of files we send you is yours to use for your own business, but not to resell or pass on as a template. Some fonts, images, and tools are licensed to us, not to you, and may not come with the files.

We can refuse or take down content that is illegal, breaks someone else’s rights, or misleads people.

We do not show your site as our work without your written OK. Client sites carry a small “Site by gerald.digital” link in the footer. Ask and we remove it.

Google listing care (Local)

Local needs manager access on the Google listing. If access is revoked and you do not write us, we try to restore it. That is still management. Billing continues until you write that you want listing care off. Listing care does not continue after your plan’s hosting has ended.

Cards and data

You pay on Stripe Payment Links. We do not collect or store card numbers on this site. Stripe processes the charge. See Privacy for what the form collects.

Maine visits and calls

A visit is for the work, not a free sales meeting. New work starts on the form, which is the fastest way to reach us. The phone button at the bottom of each page goes to voicemail. Cancel notices need to be in writing.

When things go wrong

We keep your site up and fix problems as fast as we can, but no website is up every minute of every day. Outages at our host, Stripe, Google, or your domain company, and events like storms or power loss, are outside our control.

If something goes wrong, the most we owe you is what you paid us in the 3 months before the claim. We are not responsible for lost sales, lost profits, or other indirect losses. Where the law does not allow a limit like this, it does not apply.

Changes to these terms

We may update these terms. Clients get an email at least 30 days before a change takes effect, and the new version is posted here. If you keep your plan after that date, the new terms apply. If you don’t agree, cancel before then and the old terms apply until your service ends. A price change still needs your written OK, as above.

Law and disputes

These terms follow the laws of Maine. If there is a problem, write us first and we will try to sort it out. If it goes to court, it goes to the state courts in Kennebec County, Maine.

These terms, plus anything we both agree to in writing, are the whole agreement. If one part cannot be enforced, the rest still applies.
